Epic Wellbeing – Terms & Conditions

Please READ CAREFULLY. By purchasing, registering for, or using any services, programs, or materials provided by Epic Wellbeing Limited (herein referred to as “Epic Wellbeing”, “Company”, “we”, or “us”), you (herein referred to as “Client”, “you”, or “your”) agree to the following terms and conditions.
1. SERVICES
Epic Wellbeing provides online health, wellbeing, and coaching services (the “Services”). These may include, but are not limited to:
One-on-one and Group coaching sessions
Educational courses and programs
Access to tools, resources, and calculators
Digital materials and related content
The Client agrees to abide by all policies and procedures outlined in this Agreement as a condition of their participation.
2. DISCLAIMER
The Client understands that Epic Wellbeing is not a medical or healthcare provider, and our services do not replace medical advice, diagnosis, or treatment.
Specifically:
Epic Wellbeing is not a doctor, nurse, psychologist, dietitian, physiotherapist, or any regulated medical professional.
We do not provide medical, nutritional, psychological, financial, or legal advice.
The Services are educational and coaching in nature, designed to help clients improve health habits, resilience, and lifestyle.
You are responsible for consulting with your doctor or other qualified health professional before starting any new health, fitness, or nutrition program. If you have or suspect you may have a medical condition, seek medical attention immediately.
3. SERVICE FEES & PAYMENTS
All fees are stated in USD unless otherwise specified.
For Clients based in New Zealand, fees will be charged in NZD and are subject to NZ Goods & Services Tax (GST) at the prevailing rate.
Payments are required in advance via Stripe or another approved payment provider.
Failure to make payment may result in suspension or termination of Services.
Invoices must be paid on or before the due date. Late payments may attract interest charges at [5% per month] until paid in full.
4. REFUNDS & CHARGEBACKS
Unless expressly stated otherwise, all fees are non-refundable.
Refunds may only be granted under conditions explicitly offered in writing at the time of purchase (e.g., “results guarantee” programs).
Chargebacks via your payment provider are strictly prohibited. If you initiate a chargeback, you agree to reimburse Epic Wellbeing for any costs or fees incurred as a result.
5. CONFIDENTIALITY
Both parties agree to maintain strict confidentiality of any personal, health, or business information shared during the course of Services. This includes, but is not limited to: coaching calls, progress tracking, and personal disclosures.
Confidentiality does not apply where disclosure is required by law.
6. INTELLECTUAL PROPERTY
All materials, frameworks, calculators, and content provided by Epic Wellbeing remain the exclusive intellectual property of Epic Wellbeing.
You are granted a personal, non-transferable license for individual use only.
You may not copy, distribute, resell, or reproduce our materials without written consent.
7. CLIENT RESPONSIBILITY
By engaging in our Services, you acknowledge and agree:
You are responsible for your own progress, health, and results.
Results will vary depending on your personal commitment and circumstances.
Epic Wellbeing makes no guarantees, warranties, or representations regarding outcomes.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
Epic Wellbeing shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services.
You accept full responsibility for your participation and release Epic Wellbeing, its directors, employees, contractors, and affiliates from any claims, losses, or damages.
Nothing in this Agreement excludes liability where it cannot be excluded under New Zealand law or other applicable consumer protection laws (e.g., Australian Consumer Law, UK Consumer Rights Act, EU Directive on Consumer Rights).
9. TERMINATION
Epic Wellbeing reserves the right to suspend or terminate Services if the Client:
Fails to make payment
Violates these Terms & Conditions
Behaves in a disruptive or abusive manner
Termination does not release the Client from outstanding payment obligations.
10. GOVERNING LAW
This Agreement is governed by the laws of New Zealand, and you agree that any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
International clients acknowledge that local consumer protection laws may also apply.
Note: Any currency conversion, exchange rate fluctuations, or bank/card processing fees are the sole responsibility of the Client.
11. FORCE MAJEURE
Epic Wellbeing shall not be held liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, strikes, illness, or internet outages.
12. MODIFICATION
We may update or modify these Terms & Conditions at any time. Updated terms will be published on our website and are effective immediately upon posting.
